These terms are a contract between you and Serser Software Inc. ("we", "us") governing your use of the MogSafe app (the "App").
1. what mogsafe is
MogSafe compares faces in a photo you submit against your selfie and shows a result ("mogged" or "mogsafe") generated by a third-party AI vision model. It's for entertainment. It is not a scientific, medical, psychological, or otherwise authoritative measurement of appearance, worth, or anything else. Results are subjective, can be wrong, and should not be relied on for any serious decision.
2. eligibility
You must be at least 16 years old (or the minimum age of digital consent in your country) to use MogSafe. If you are under 18, you confirm you have a parent or guardian's permission.
3. your account
You're responsible for keeping your sign-in method secure. You're responsible for everything that happens under your account.
4. photos you submit
- You may only submit photos you have the right to use. By submitting a photo, you confirm you have permission to upload every face that appears in it, including people other than yourself.
- Don't upload photos of children (other than yourself, if you're a minor using the app with permission), explicit content, or photos you don't have rights to.
- You're responsible for how you use results generated from photos of other people. Don't use MogSafe to harass, bully, or embarrass anyone.
- We may remove content or suspend accounts that violate this section.
5. free checks and subscriptions
- New accounts get a limited number of free checks, described in the app. After that, continued use requires an active subscription.
- Subscriptions (weekly or yearly, as offered in the app) are billed through the Apple App Store (or Google Play, if offered there) and auto-renew unless you cancel at least 24 hours before the current period ends. Manage or cancel your subscription in your Apple ID or Google account settings — we cannot cancel it for you.
- If a trial is offered, it's described at the paywall and in your store account settings before you're charged.
- Prices are set in the App Store/Play Store and may vary by region; they are not fixed by us in this document.
- We do not offer refunds directly — refund requests go through Apple or Google, per their policies.
- After 50 checks in a day, further checks on any account, including subscribers, run more slowly, as an abuse safeguard.
6. acceptable use
Don't: reverse-engineer the app, abuse the free-check limit or the daily slow-down through automation or multiple accounts, resell access, or use the app to build a competing product. We may suspend or terminate accounts that do.
7. disclaimers
MogSafe is provided "as is." Results come from a third-party AI model and may be inaccurate, inconsistent, or offensive. We don't warrant that the app will be uninterrupted, error-free, or available at all times.
8. limitation of liability
To the maximum extent the law allows, Serser Software Inc. is not liable for indirect, incidental, or consequential damages arising from your use of the app, including any emotional distress arising from a result. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.
9. termination
You can stop using MogSafe and delete your account at any time. We may suspend or terminate your access for violating these terms.
10. changes
We may update these terms. Continued use after an update means you accept the new terms.
11. governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. This does not take away any consumer protection rights you have under the laws of the place where you live.
12. apple app store
If you downloaded MogSafe from the Apple App Store, these terms are between you and Serser Software Inc., not Apple. Apple is not responsible for the App or its content, has no obligation to provide maintenance or support for it, and is not responsible for any claims relating to it (including product liability, legal compliance or intellectual property claims). If the App fails to meet any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any; to the maximum extent the law allows, Apple has no other warranty obligation. You confirm you are not located in a country subject to a U.S. government embargo and are not on any U.S. government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. Your use of the App must also comply with Apple's Usage Rules in the App Store Terms of Service.
